(“Point Blank”) announced today that the same plaintiffs (and same attorneys) whose class action complaint against Point Blank was dismissed on October 29, 2018 filed a new putative class action complaint against Point Blank in the Southern District of Florida, based upon the same core allegations and claims as their previously‐dismissed complaint. The new complaint again alleges that the hook‐and‐loop material in theSelf‐Suspending Ballistic System (“SSBS”) feature of concealable Point Blank vests wears out over time with use.Plaintiffs do not assert that the ballistic panels contained in Point Blank vests are defective or do not perform according to National Institute of Justice standards. On October 29, 2018, The United States Federal Court, in the southern district of Florida denied a motion for class certification filed against Point Blank Enterprises, Inc., and dismissed the case. In the case (OSTA, et al. v. Point Blank Enterprises, Inc., 0:17-cv-62051-UU, S.D. Fla.), a few individual Ohio police officers and two law enforcement associations alleged that a nationwide class should be certified to pursue claims that Point Blank’s Self-Suspending Ballistic System (SSBS) for shoulder straps used on bulletproof vests were defective.
